WOLF ORDERED TO TURN OVER TAPE OR RETURN TO JAIL

Freelance video journalist Josh Wolf could return to jail this afternoon if he does not turn over a videotape sought by federal authorities after the 9th U.S. Circuit Court of Appeals revoked his bail.

A three-judge panel of the Ninth Circuit issued the order revoking Wolf's bail on Tuesday and ordered him to appear before a federal grand jury at 1 p.m. today and produce the videotape he shot in July 2005 of an anarchist demonstration in San Francisco.

"Appellant is ordered to appear before the grand jury to testify and produce all materials requested in the attachment to the grand jury's subpoena, or surrender to the facility where he was previously incarcerated,'' according to the order by Judges Diarmuid O'Scannlain, Susan Graber and Richard Clifton.

Wolf, 24, has refused to turn over the videotape on First Amendment grounds. He has already spent approximately one month in jail at the Federal Correctional Center in Dublin.
